U.S Code on "Fair Use"

http://www.law.cornell.edu/uscode/17/107.shtml

The following is adapted from a readme file on the lecture DVD

B) LEGALITIES

These recordings are for historical, research, and educational purposes only. They are made to preserve the teachings of Richard Rose, specifically to overcome the aging of magnetic tape. Without the conversion to digital format the tapes would eventually be lost.

Distribution is intended to be very narrow, only to those close to the study of Richard Rose's system, and is not intended for the general public. This catalog is intended for the advancement of knowledge, to help sort through RR's work so that researchers may develop a wider understanding than can be gleaned from published materials.

The summary sheets are provided as a topic index (not as verbatim transcriptions) for purposes of cataloging the recordings.

RR devoted his life to discovery of truth and making his findings available on a strictly not-for-profit basis. To introduce money into this equation would be subversive to the principles he advocated throughout his life.

Over a period of many years, tape recordings were made of RR's lectures and conversations. In his presence and the presence of hundreds of people over the years, duplicated copies of these tapes were distributed at cost to the general public (generally at about $1 each, the cost of the cassette, not even including duplicating costs). Conceivably, thousands of these tapes may be in the hands of the general public (e.g., 50 copies of 50 lectures would be 2,500 copies).

However, notwithstanding the number of copies in existence, the process of decay over time of magnetic tapes is well known.

This disk includes no remastered recordings that are available to the public on a commercial basis. (Under law, no infringement of legitimate commercial interests is permitted.) Additionally, the audio quality of most of this material is generally insufficient for commercial distribution.

Specifically regarding legalities:

1. The present effort is made purely to restore magnetic tapes which were widely distributed to the public on a not-for-profit basis, by converting them here to digital format.

2. Only through the preservation of original material can accurate study of Richard Rose's ideas be made. Extant works include books authored by RR and a few recordings that have been published commercially, unpublished letters and correspondence, published works by RR's students that relate RR's teachings on a second-hand basis, and the recorded lectures distributed to the public over two or three decades, some of which are on this disk. For true research and accurate understanding, the distributed tape recordings should be made available to researchers before they disappear.

3. As a younger generation of students of RR's work did not have the benefit of sitting through RR's lectures and conversations, their full research efforts will only be possible by access to these recordings and/or the cataloging and indexing of such. This work must be shared in order to effectively distribute the workload, to avoid the work being abandoned or lost via failure of one or a few persons.

4. If you want to avoid legal troubles, you should read and abide by fair use provisions, such as described here:

http://fairuse.stanford.edu/Copyright_and_Fair_Use_Overview/index.html

5. Specifically, you may do nothing that would deprive a legitimate commercial interest of income.

6. The present effort is: a) restoration/preservation; b) for research; c) for non-commercial, educational purposes. Please note the word "or" in the definition below from the Stanford site:

"Educational purposes" means:

> non-commercial instruction or curriculum-based teaching by educators to students at nonprofit educational institutions
> planned non-commercial study or investigation directed toward making a contribution to a field of knowledge, or
> presentation of research findings at non-commercial peer conferences, workshops or seminars.

7. You should note that the Stanford pages states that there is a certain degree of subjectivity in legal claims. Please understand that if you deviate from accepted legalities you could not only get yourself in trouble but you could jeopardize the legitimate research work of other parties.
